ON THE ISSUE OF AMENDMENTS TO THE FEDERAL LAW OF JANUARY 9, 1996 NO.3-FZ “ON RADIATION SAFETY OF POPULATION” (PREPRINT IBRAE-2020-03)

The paper describes the reasoning behind the adoption, as well as subsequent regulatory application of the Federal Law of January 9, 1996 No.3-FZ “On radiation safety of population”. Analysis is provided for in-force edition of the Law and for the prospects of its future application and development. Two possible options are considered. The first and the preferable option is to revoke the document due to its very low regulatory effect. The second option (in the case the first option would not be acceptable) is to develop amendments and modifications for the Law.
Special attention is paid to analysis of proposals on amending specific articles of the law (in accordance with the draft law “On introduction of amendments to the Federal Law of January 9, 1996 No.3-FZ “On radiation safety of population”, which was published on the Federal portal of the draft regulatory acts regulation.gov.ru for the purpose of public discussion, ID 02/04/05-20/00101773).
The final section describes the optimal contents of the amended law in the case the second option is taken.
